Acceptable Use Policy
1. Scope
This Acceptable Use Policy applies to every User of BayWa One (the "Service") provided by [LEGAL ENTITY: e.g. BayWa r.e. Solar Systems LLC] ("BayWa r.e."). It forms part of the Terms of Service, and words defined there have the same meaning here. Your company is responsible for its Users following it.
2. Homeowners and their information
You may not:
- enter a person's information, or create a project for them, unless they have asked you about a solar system or you otherwise have a lawful basis to contact them;
- send a Homeowner's information to a Third-Party Service, including submitting a credit or loan application, without that Homeowner's permission;
- enter information the Service does not need, such as government identification numbers, bank details or health information, in free-text fields, notes or uploaded files;
- upload a document you do not have the right to use or share;
- use the Service to send unsolicited messages, or send proposals or agreements to anyone other than the Homeowner they concern or someone they have authorised.
3. Honest proposals
You may not use the Service to mislead a Homeowner. In particular, you may not:
- present an estimate of production, savings, payback or utility costs as a guarantee;
- set assumptions you do not believe are reasonable, such as a utility rate escalator or a tax credit rate your own adviser does not support, in order to make a proposal look better;
- describe a lease or power purchase agreement as a purchase, or leave out an escalator or other term that raises what the Homeowner pays;
- suggest that you are BayWa r.e., or acting on behalf of BayWa r.e., a utility, a government body or a financing provider, or that any of them endorses your offer;
- alter a document generated by a financing provider or a Third-Party Service and present it as theirs.
4. Security and the integrity of the Service
You may not:
- share a sign-in, use another User's sign-in, or create accounts for people who are not your company's employees or contractors;
- attempt to access another company's account or data, or to get around roles, permissions, acknowledgements or any other control in the Service;
- probe, scan or test the vulnerability of the Service, except under a written arrangement with BayWa r.e.;
- introduce malware, or upload files designed to exploit the Service or a Third-Party Service;
- scrape, crawl or extract data from the Service by automated means, or place load on it that degrades the experience of other customers, without BayWa r.e.'s written permission;
- copy, reverse engineer or decompile the Service, or use it to build a competing product;
- extract BayWa r.e.'s pricing or catalogue to share with anyone outside your company.
If you find a vulnerability, report it to [SECURITY CONTACT EMAIL] and do not use or disclose it further.
5. The law
You may not use the Service in breach of any law that applies to you, including consumer protection, home solicitation, telemarketing, electronic communications, fair lending, privacy and licensing laws, or in a way that infringes anyone else's rights.
6. Enforcement
BayWa r.e. may investigate a suspected breach of this policy, and may remove content, suspend a User or suspend your account as described in the Terms of Service. Where the law requires it, BayWa r.e. may report a breach to the relevant authorities.
Report misuse of the Service to [SECURITY CONTACT EMAIL].
7. Changes
BayWa r.e. may update this policy. Each version has a version identifier derived from its text, and each User is asked to accept a new version before continuing to use the Service.
